Terms of Service & Forecourt SLA
Terms for fuel retail outlets using the PetroHive software-as-a-service platform.
Last updated: October 2026
1. The service
PetroHive provides cloud software for shift settlement, nozzle and tank telemetry, fleet credit ledgers and multi-station reporting. By creating an account or using the platform, the dealer agrees to these terms on behalf of its outlet(s).
2. Statutory compliance disclaimer
PetroHive provides calculation and telemetry automation. Physical and legal compliance with PESO requirements, OMC dealership guidelines, legal metrology and any other applicable regulation remains the responsibility of the dealer and is subject to the dealer's own supervision. Outputs from the platform are decision aids and do not replace statutory records, inspections or calibration.
3. Uptime SLA and backups
- Availability target: 99.9% monthly uptime for the production platform, excluding scheduled maintenance announced in advance and events outside our reasonable control.
- Offline operation: cashier workflows are designed to continue during connectivity loss and sync on reconnection.
- Backups: automated database backups are taken on a regular schedule and restore procedures are tested periodically.
- Remedies: service credits for SLA breaches, if any, are described in the dealer's order form.
4. Account security and staff OTP rules
- Dealers are responsible for the accounts they create and for activity under them.
- Credentials and OTPs are personal; they must not be shared, and staff accounts must be deactivated promptly when an employee leaves.
- When a staff mobile number is transferred or changed, the dealer must re-verify the new number through OTP before access is restored.
- We may suspend access to prevent fraud or abuse and will tell the dealer why where possible.
5. Acceptable use
The platform must not be used to falsify records, circumvent OMC or statutory controls, probe other tenants' data, or interfere with the service.
6. Software license and Indian Copyright Act, 1957
PetroHive is proprietary commercial closed-source software licensed on a subscription basis, not sold. It is not open-source, public domain, or freeware. All title, ownership rights, algorithms, database schemas, and intellectual property rights in and to the platform remain exclusively with PetroHive.
The software, its underlying source code, features, algorithms (including tank calibration mathematical tables and forecourt reconciliation rules), user interfaces, and documentation are protected under the Indian Copyright Act, 1957 and applicable international intellectual property treaties.
Dealers receive a limited, revocable, non-exclusive, non-transferable license to access and use the platform solely for operational petrol pump station management. Dealers and users may not copy, decompile, reverse-engineer, disassemble, rent, lease, sub-license, scrape with automated bots, or create derivative works from the platform.
7. B2B commercial service (consumer law exclusion)
PetroHive is intended exclusively for use by commercial petroleum retail dealerships and corporate fleet operators, and not for personal or household consumer purposes. To the maximum extent permitted by law, statutory consumer protection laws do not apply to subscriptions under these terms.
8. Cancellation and refund policy
- Trial evaluation: Dealers are provided a complimentary 15-day or 30-day trial with complete feature access and no payment card required to thoroughly evaluate forecourt suitability before entering into any paid commitment.
- Final and non-refundable: Once a paid subscription plan or renewal is confirmed, all payments are final and non-refundable. Because multi-tenant cloud storage, telemetry resources, and tenant database instances are provisioned immediately upon billing, no partial or pro-rated refunds are issued.
- Non-usage disclaimer: Failure to actively log shifts, input nozzle dips, or access the software during an active subscription term does not constitute a valid basis for refund, fee reduction, or refusal to honor payment obligations.
- Cancellation of auto-renewal: Dealers may cancel upcoming billing renewals at any time directly through the station settings or by contacting billing support in writing before the renewal date. Following cancellation, access remains active until the end of the paid billing period.
9. Fees, term and termination
Fees, billing cycle and renewal are set out in the dealer's subscription order. Either party may terminate in line with agreed terms. Upon account termination, the dealer may request a 30-day export window to download all historical nozzle readings, customer ledgers, and shift reconciliation records as described in the Privacy Policy prior to scheduled data archival.
10. Disclaimer of consequential damages and liability limitation
In no event shall PetroHive, its creators, or hosting partners be liable for any indirect, incidental, or consequential damages, including without limitation: lost fuel sales, forecourt business interruption, meter testing variances, or third-party telecom downtime. Total liability is limited strictly to the subscription fees paid for the affected calendar billing month.
11. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of India. Questions regarding these terms can be directed to [email protected].
